At the meeting on Monday 27 March 2023, Council endorsed the North Wallarah Peninsula Planning Proposal. You can view the Council report (page 101) and Planning Proposal online. 

The Planning Proposal became effective on 9 June 2023 and supports housing diversity at properties on Old Pacific Highway, Pinny Beach. It also ensures height of buildings and subdivision provisions in the LEP 2014 are consistent with the provisions in the adopted North Wallarah Peninsula Area Plan of the Lake Macquarie Development Control Plan 2014. This will ensure any future development reflects the unique environmental and visual attributes of the North Wallarah Peninsula.

The proposal is intended to: 

  • reduce the height of building standard to mostly 5.5m, 8.5m and select areas to 12m
  • introduce a mostly 450m2 minimum lot size standard
  • permit subdivision of land into three lots where each resulting lot is between 300m2 and 450m2, has frontage to a public road and specifies a building envelope
  • restrict dual occupancy development to lots that have a minimum size of 620m2 unless they are corner lots, and
  • permit subdivision that creates a corner lot of at least 500m2 and permit subdivision that creates a battle-axe lot of at least 600m2.
